This kind of back and forth examination can take months before both sides have satisfied their requirements, and have properly presented their side of the case.

Any evidence used to prove or disprove a claim is carefully examined until it’s deemed relevant and useful. Evidence is presented during the settlement stage and represents a last opportunity to resolve the claim before the courts become fully involved.

A settlement can take place at any time, and is generally influenced by how solid the plaintiff’s case is. Often, if the defendant’s attorney advises that the plaintiff’s claim is strong, and may well prevail in court, a settlement is offered in order to speed up the process and to save money. If this occurs, an agreement may be reached rather quickly.
